**** ANITA CHAUDHRY, J The petition had been filed seeking directions for transfer of the investigation of FIR No. 143 dated 11.11.2013 registered under Sections 363, 366-A IPC at Police Station Division No. 4, Ludhiana. The statement made on behalf of the petitioner on the first hearing was that the allegations regarding rape had also been levelled but the police was not taking any action. Thereafter notice was issued to the State and status report was called for and in its various affidavits and short replies, the State had given the efforts put in by them to arrest the accused. On the last date of hearing, the State counsel had informed that the accused was declared proclaimed offender but he was subsequently arrested and challan was presented and the trial was going on. The case was adjourned for verification of these facts by the petitioner. Crl. Misc. No. M-14095 of 2014 -2only against Mohammad Shahid.
The accused has already been arrested and challan has been presented and trial is going on. The police did not find any evidence against the other persons later named in the FIR. The petitioner has a remedy and can avail the same. No case for transfer of investigation is made out. The petition is disposed of.
