The present contempt petition has been filed for non-compliance of order dated 28.05.2024 passed by Division Bench of this Court in CWP-7018-2022. 2.

On the last date of hearing i.e 18.05.2026, following order was passed:- "Compliance report by way of affidavit dated 07.04.2026 of Amit Kumar, Naib Tehsildar, Dahina, Rewari, along with Annexures R-1 to R-5, has been filed on behalf of respondent No.1 in the Registry. The same is taken on record.

"A perusal of paragraph No.9 of the said compliance report shows that the mortgaged property is part and parcel of joint holdings and the representative of petitioner bank was asked to point out the particular area of mortgaged property of which they claim the possession, but they failed to identify and explain the specific area of the mortgaged property and also could not explain the specific possession of the mortgagor in the joint holdings.

Learned counsel for the respondents submits that symbolic possession of the mortgaged property has already been given to the petitioner, GAURAV ARORA 2026.05.29 17:17 I attest to the accuracy and integrity of this document

COCP-764-2026 whereas, in compliance of the order passed by this Court, physical possession was required to be delivered to the petitioner. Learned counsel for the petitioner contends that the petitioner shall accompany the respondents along with the Revenue Officer and police officials and shall identify the mortgaged property so that the possession thereof may be handed over.

Adjourned to 29.05.2026.

Both the parties are ad idem that they will do the needful by Monday and the petitioner shall approach the officers of the Revenue Department and police officials for necessary assistance."

Learned counsel for the respondents submits that in compliance of the above referred to order, physical possession has been granted to the petitioner. He has placed on record possession proceedings dated 25.05.2026. The same is taken on record, copy whereof has also been supplied to learned counsel for the petitioner. Registry is directed to tag the same at an appropriate place. 4.

A perusal of above possession proceedings dated 25.05.2026 shows that possession has been granted to the petitioner and the same is also signed by the petitioner. 5.

In view of the above, the contempt is purged. Rule is discharged. 6.
