ARUN MONGA, J. (ORAL) Matter was taken up for hearing on 10.04.2023, when none appeared for the respondent and Registry was asked to issue notice to respondent as well as his counsel. Needful has been done. As per office report, notice sent to respondent No.1 has been received back with the report that he has died, while learned counsel for respondent has been informed through e-mail but none appears for respondents.

On resumed hearing today, it transpires that Mr. S. C. Chhabra, Advocate who has filed instant appeal has since quit practice and on his request, Mr. Gurmeet Singh Saini has appeared. On a Court query, he candidly states that he is not in touch with the appellants and Mr. Chabbra, also wrote letter which has not been responded and therefore, he is not aware whether appellants are interested in pursuing the appeal or not.

Be that as it may, instant appeal is dismissed for nonprosecution with liberty to learned counsel for the appellants to revive the SHALINI BHATIA 2023.04.27 17:08 I attest to the accuracy and integrity of this order/ judgment
