The petitioner has filed the present petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure with a prayer to direct the respondents No.2 and 3 to protect the life and liberty of the petitioner as the police officials are unnecessarily raiding the house of the petitioner and harassing his old parents and other family members.

A status report by way of an affidavit of the Deputy Superintendent of Police, Sub Division Sri Hargobindpur, Police, District Batala has been filed on behalf of the respondents No.1 to 5 and the same is taken on record.

Learned State counsel submits that the present petitioner is hardened criminal and was involved in three FIRs are as follows:- Sr. No.

FIR No.04 dated 22.01.2013 under Sections 22/61/85 Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Qadian Convicted for 10 years and fine of Rs.1,00,000/- 2.

FIR No.118 dated 18.07.2024 under Sections 323, 341, 148 and 149 IPC Police Station City Gurdaspur Acquitted on 23.07.2018 3.

FIR No.05 dated 19.01.2015 under Sections 353, 186 and 323 IPC Police Station City Gurdaspur Undergone imprisonment 4.

He further contends that since the petitioner is involved in criminal activities, the local police is keeping the surveillance on the SIMRANDEEP KAUR 2024.08.02 16:33 I attest to the accuracy and integrity of this order/judgment

CRWP-2026-2024 -2petitioner. Apart from that, the police has not raided the house of the petitioner. Learned State counsel further submits that no family members of the petitioner has been harassed by the police officials, as alleged. He further contends that in case the petitioner is found involved in any criminal activities, the necessary action shall be taken by strictly adhering the process of law. He further contends that as per the verifications conducted by the police, there is no threat to the life and liberty of the present petitioner at present.

In view of the statement made by the learned State counsel, no further directions are required and the present petition is accordingly disposed off.
