ARUN MONGA, J. (ORAL) Appellants (plaintiff) are in second appeal before this Court assailing First Appellate Court judgment and decree dated 19.09.1991 vide which judgment and decree dated 24.07.1987 passed by trial Court was set-aside. By way of alternative relief, recovery of Rs.36,000/- with interest @ 12% per annum from 25.08.1973 till its realization with costs was ordered.

Suit for specific performance of contract was filed by plaintiff/appellant (herein), which was decreed by learned trial Court. Appeal filed by one of the defendants against the said judgment and decree was allowed by learned First Appellate Court and the judgment passed by the trial Court was reversed.

Appeal was admitted on 22.01.1992 and was earlier taken up for hearing on 09.01.2023 when counsel for appellant sought time to file power of attorney.

Today, neither any one has caused appearance on behalf of appellant nor power of attorney has been filed. 5.

Dismissed in default.
