Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.176 dated 16.05.2004 under Sections 394, 392, 397 and 34 IPC, registered at Police Station Nakodar, District Jalandhar.

Notice of motion.

Ms.Monika Jalota, DAG, Punjab, has put in appearance on behalf of the respondent-State and contested the petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the present petitioner was earlier released on regular bail and he absented from the Court proceedings on 17.01.2019 and his non-bailable warrants were issued for 05.02.2019. CRM No.M-9419 of 2019 -2not intentional, rather, he mistook the date. The trial of the case will take long time. No useful purpose will be served by sending the petitioner to custody. Therefore, finding merit in the present petition, the same is allowed. The petitioner is directed to appear before the learned trial Court within ten days from today and also to deposit `10,000/- as costs with the District Legal Services Authority, Jalandhar and on doing so, he shall be released on bail by the learned trial Court to its satisfaction. If the petitioner fails to comply with this order, then this bail petition shall be treated as dismissed.
