This is the second petition under Section 439 of the Cr.P.C., whereby, the petitioner has sought the relief of regular bail, in case FIR No.507 dated 03.12.2021, under Sections 302, 34 of the IPC, registered at P.S. City Bahadurgarh, District Jhajjar.

In compliance of the directions issued by this Court on 23.07.2024, the learned State counsel has, on instructions imparted to him by the quarter concerned, informed this Court that, only two prosecution witnesses are left to be examined before the learned trial Court concerned, and, out of those two witnesses, the examination-in-chief of one of the witnesses has already been recorded. He has further submitted that the examination of those two prosecution witnesses would be completed within two months from the next date of hearing fixed before the learned trial Court concerned.

In view of the submission(s) made by the learned State DEVINDER YADAV 2024.08.13 18:10 I attest to the accuracy and authenticity of this order/judgment
CRM-M-10522-2024 (O&M) counsel, the learned counsel for the petitioner seeks leave to withdraw the instant petition, however, he also prays for issuance of directions upon the learned trial Court concerned to complete the examination of the remaining two prosecution witnesses within the above stated timeframe. 4.
Leave granted.

Consequently, the instant petition is dismissed as withdrawn. Moreover, the learned trial Court concerned is also directed to, within two months from the next date of hearing fixed before it, ensure completion of examination of both the remaining prosecution witnesses. The S.S.P. concerned is also directed to ensure the presence of both the remaining prosecution witnesses, on each and every date, as fixed by the learned trial Court concerned, for their examination. 6.
Insofar as the relief of interim bail to the petitioner is concerned, regarding which application No. CRM-31052-2024 has been filed before this Court, the petitioner is at liberty to claim this relief before the learned trial Court concerned.
