ARUN MONGA, J.(ORAL) Having suffered concurrent adverse findings by two Courts below, plaintiff/appellant is in second appeal before this Court assailing judgment and decree dated 15.10.1988 passed by learned trial Court, as upheld by learned First Appellate Court vide judgment and decree dated 01.02.1992, dismissing suit for possession filed by plaintiff/appellant. 2.

Matter was taken up for hearing on 10.01.2023, when Registry was asked to issue notice to learned counsels for parties. Office report reveals that power of attorney holder of appellant has died. Respondent No.2 is also reported to have died. 3.

It appears that appeal was since filed by attorney holder of appellant who has since expired but no steps have been taken by the appellant to take alternative arrangements to engage a counsel. 4.

Dismissed in default.
