Kulwinder Singh v. State Of Punjab
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH CRM-M-14173-2017 (O&M) Date of Decision : 09.05.2017 KULWINDER SINGH ...PETITIONER
VERSUS
STATE OF PUNJAB ...RESPONDENT CORAM : HON'BLE MR. JUSTICE AMOL RATTAN SINGH
Present:
Mr. Vishal Sharma, Advocate for the petitioner. Mr. Rajesh Mehta, Addl. A.G., Punjab.
------ AMOL RATTAN SINGH, JUDGE (ORAL) Despite the order dated 05.05.2017, by which the petitioner had been asked whether he is willing to return, with interest, the Rs.1,00,000/- (at least at this stage), stated to have paid into the account of the petitioner by the complainant, he submits that, as a matter of fact, two cheques by way of security have been given by the petitioner to the complainant, which has also been found to be so by the investigating agency. Mr. Mehta, learned State counsel, on instructions from ASI Rash Pal Singh, however, denies that the investigating agency has come across any such cheques.
It is further to be seen that even in the petition, there is no mention made of any cheques given by way of security. Considering the aforesaid circumstances, I see no reason to entertain this petition seeking anticipatory bail. Dismissed.
However, it is made clear that nothing observed herein-above will be taken to be a final comment on the merits of the case, which would be gone into by the trial court after appraisal of the evidence led before it. (AMOL RATTAN SINGH) JUDGE May 09, 2017 adhikari/rajneesh Whether speaking/reasoned:
