(ORAL) After arguing for some time, learned counsel for the petitioner submits that he would be contended and satisfied if this Court directs the trial Court to expedite the trial because driver of the truck was in ITBP and is going to retire shortly. Learned counsel for the complainant submits that he has no objection in case the trial is expedited.

The prayer is genuine, the same is allowed.

Given above, the present petition is disposed of and this Court requests the learned trial Court to expedite the trial and try to complete it on or before 31.05.2023. Parties are directed not to seek any adjournment. Since, the petitioner is posted at border area.

Given above, it shall be permissible for the petitioner to represent through his counsel provided he does not claim any prejudice in this regard and such exemption is granted for all dates except at the time of recording of statement under Section 313 Cr.P.C and pronouncement of final judgment.
