**** AJAY TEWARI, J.(Oral) On 14.7.2017, the following order was passed :- "Proxy counsel for the appellant states that counsel engaged by the party has now stopped practice.
Let fresh notice be sent to the appellant so that he can engage a counsel for him.
Adjourned to 01.11.2017."
It has been reported that notice issued to the sole appellant has been received back with the report of refusal and affixation has been made. Counsel appearing for the respondent No.1 states that as per her information the matter has been settled long ago between the parties. Be that as it may. Since the appellant has refused to appear it has to be held that service is effected but none has put in appearance on his behalf. In the circumstances, the appeal stands dismissed for want of prosecution.
Since the main case has been decided, the pending C.M, if any, also stand disposed of.
