******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.0032 dated 20.02.2018 registered for the offences punishable under Sections 452, 325, 323 read with Section 34 of Indian Penal Code (for short-IPC), at Police Station Sangat, Bathinda, District Bathinda. Heard.

Learned counsel for the petitioner submits that the matter has since been amicably settled with the complainant and injured witnesses. Learned State counsel endorses the submission of learned counsel for the petitioner and submits that matter is still under investigation. The matter has since been amicably settled and all the offences except offence punishable under Section 452 IPC are bailable. CRM-M-15078-2018 -2is allowed and petitioner is directed to surrender before the Investigating Officer and join the investigation within 7 days. In the event of his arrest being required, he shall be released on anticipatory bail, subject to his furnishing bonds to the satisfaction of Arresting Officer. However, he shall abide by the terms and conditions as envisaged under Section 438(2)(i) to (iv) Cr.P.C. failing which he shall lose the benefit of interim bail allowed to him.

It is, however, made clear that in the event of petitioner not surrendering before the Investigating Officer within 7 days, the order allowing bail to him shall stand withdrawn automatically. ( SURINDER GUPTA ) May 07, 2018 JUDGE Sachin M.
