The present regular second appeal has been filed against the judgment dated 12.03.1992 passed by learned Additional District Judge, Gurdaspur whereby the appeal filed against the judgment and decree dated 02.06.1990 is dismissed. 2.

Learned counsel for the appellant pleads no instructions. 3.

On the other hand, learned counsel appearing for respondent Nos.2 and 3 submits that the property has been auctioned and the sale certificate issued in favour of the Bank on 05.06.1982, on account of which the Bank is the owner of the said suit property.

It appears that the appellant is not interested in pursuing the present appeal.

Dismissed for non-prosecution.
