ARUN MONGA, J.(ORAL) Having suffered concurrent adverse findings by two Courts below, defendant/appellant Committee is in second appeal before this Court assailing judgment and decree dated 15.11.1990 passed by learned trial Court, as upheld by learned First Appellate Court vide judgment and decree dated 21.08.1991, whereby suit for declaration filed by the plaintiff/defendant was decreed with costs.

Case was taken up for hearing on 10.01.2023 when learned counsel for appellant caused appearance and Registry was asked to issue notice to learned counsel for respondent.
