The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR No.131 dated 13.1.2019 at Police Station Majitha Road, Amritsar under Section 408 of Indian Penal Code. 2.

At the time of issuance of notice of motion on 18.3.2021, the following order was passed :

"Learned counsel for the petitioner contends that although as per the FIR there are allegations to the effect that an amount of `2.59 lakhs approximately apart from stock of about `1 lakh approximately had been misappropriated by the petitioner, but the said allegations cannot be said to be correct inasmuch as the petitioner was appointed in 'Trillium Mal' PANKAJ KAKKAR 2021.08.03 19:02 I attest to the accuracy and integrity of this document

( 2 ) CRM-M-12558-2021 (O&M) as a Customer Service Associate and was never entrusted with any duties pertaining to receipt or accounting of cash.

Notice of motion for 3.8.2021.

Meanwhile, in the event of arrest, the petitioner be released on interim bail subject to his furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C." 3.

Learned State counsel, upon instructions from ASI Sawinder Singh, has informed that pursuant to interim directions issued by this Court the petitioner has since joined investigation. It has, however, been informed that the amount embezzled by the petitioner is about `3.74 lakhs. The petitioner is, however, not stated to be involved in any other case. 4.

Having regard to the nature of allegations and the involved and while bearing in mind that the petitioner has since joined investigation, the present petition is accepted and the interim directions issued by this Court vide order dated 18.3.2021 are hereby made absolute, subject to the condition that the petitioner shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438(2) Cr.P.C. 3.8.2021 ( Gurvinder Singh Gill ) pankaj Judge Whether speaking /reasoned Yes / No Whether Reportable Yes / No PANKAJ KAKKAR 2021.08.03 19:02 I attest to the accuracy and integrity of this document
