The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of award dated 29.09.1997 (Annexure P-8) whereby Labour Court has granted lump sum Rs.10,000/- instead of full back wages while reinstating him with continuity of service.

The respondent-management by order dated 08.07.1991 dismissed the workman. He was working as Driver and his vehicle met with an accident on 07.10.1989. He was charge-sheeted on account of accident. On his application, the matter came to be referred to Labour Court which vide impugned award decided reference in his favour. He was ordered to be reinstated with continuity of service, however, lump sum Rs.10,000/- was awarded in lieu of back wages. The petitioner is claiming full back wages instead of lump sum Rs.10,000/-. He was granted substantial relief of reinstatement and continuity of service besides Rs.10,000/- for back wages. 4.

Despite multiple adjournments, there is no representation of the petitioner.

Dismissed with liberty to the petitioner to move an appropriate application within three months from today, if cause survives. 6.
