ARUN MONGA, J. (ORAL) Appeal was filed way back in the year 1993 and while admitting the appeal, following order was passed : "

Admitted.

Execution of the judgment and decree of the Courts below is stayed subject to the appellant furnishing suitable security to the satisfaction of the executing Court." Apropos, when the matter was taken up for hearing on 12.04.2023, learned counsel for appellant, on a Court query as to implementation of aforesaid order, sought time to get instructions with regard to furnishing of suitable security.

On resumed hearing today, learned counsel for appellant appears and pleads no instructions on the ground that despite his various attempts, he could not establish contact with his client. It seems that by sheer effluxion of time as the appeal is pending for the past more than 30 years, appellant has lost interest in pursuing the appeal.
