This Court has heard the rival submissions made by learned counsel for the parties at considerable length. 6.

The petitioner is alleged to have formed membership of an unlawful assembly with the co-accused and in prosecution of common object of that unlawful assembly, injuries were caused to the victim-Sahil. Two of these injuries have been opined to be grievous in nature and remaining have been opined to be simple in nature. No specific injury has been attributed to the petitioner. Though he is alleged to have fired a shot, however, no firearm injury has been sustained by the victim Sahil. The petitioner is in custody for a period of over 01 year and 06 months. Trial will obviously take time to conclude as only 03 out of 16 prosecution witnesses examined so far. The petitioner is alleged to be involved in some other cases, but his involvement therein cannot be considered to be a reason for denying benefit of bail to him.
