CM No. 7324-C of 2016 This is application under Order XXIII Rule 3 read with Section 151 of the Code of Civil Procedure (CPC) for dismissal of main appeal in view of compromise.
Application is supported by affidavit, as such, the same is allowed and the appeal is taken up on board today itself. RSA No. 1642 of 1992 Learned counsel for the appellant seeks permission to withdraw the instant appeal submitting that the matter has already been amicably settled between the parties. He has placed on record panchayati compromise as Annexure P-1 but does not press for passing of any order on the basis of said compromise.
