IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CRM M-15207 of 2016 Date of decision : 16.05.2016 Ashok ....Petitioner V/s State of Haryana ....Respondent BEFORE : HON'BLE MR. JUSTICE RAJAN GUPTA

Present:

Mr. Bijender Dhankar, Advocate for the petitioner. RAJAN GUPTA J.

Petitioner has posed challenge to order dated 12.04.2016 passed by Additional Sessions Judge, Hisar. FIR was lodged on complaint of Sarjeet @ Badshah. He stated that accused had accosted the complainant side on 24.01.2013 and assaulted them with sharp edged weapons/guns. Various injuries were caused. Pursuant to FIR, investigation ensued. Trial of the case is in progress and is nearing culmination. At this stage, application has been moved by petitioner seeking to recall PW7 Surjeet, PW8 Pradeep and PW15 SI Bhim Singh for cross-examination. Only ground urged before this court is that said witnesses were not properly cross-examined. Petitioner has changed his counsel, thus, witnesses need to be recalled. I find no infirmity with the well reasoned order passed by the court below.

It is apparent that petitioner is only trying to delay the trial. Cross-examination of the three witnesses has been perused. It is evident that said witnesses have been cross-examined at length by the defence counsel. There is no ground to interfere in revisional jurisdiction. Dismissed.
