The present appeal is filed against concurrent findings of fact recorded by the Courts below in a suit filed by the plaintiff-appellant for declaration and permanent injunction.

Learned counsel for the respondent submits that the dispute in this case was inter-se brother and sister, appellant being the brother, who has now passed away. In the notice of motion order itself it was recorded that the appellant was ready and willing to settle the matter. A compromise has been arrived at between the parties on 08.11.2023, a photocopy of which has been produced and placed on record as Mark-A.

Learned counsel for the appellant submits that despite his best efforts, he has not received any instructions from the legal heirs of the deceased-appellant. 4.

Dismissed for non-prosecution.

Registry is directed to send a copy of this order to the appellant at the last known address, as also to the concerned SHO of the area to intimate the same. 6.

A period of three months is granted for seeking recalling of this order.
