Mr. Vivek Sharma, Advocate, for the petitioner. Rajan Gupta, J. (Oral) Petitioner has preferred this petition seeking a writ in the nature of mandamus to direct the respondent to consider him for appointment as Clerk under the Ex-servicemen/Dependent of Ex-servicemen Category. On 27.09.2016, respondent-department issued advertisement for recruitment to 1883 posts of Clerks. Out of which, 377 posts were reserved for Ex-servicemen/Dependent of Ex-servicemen. Petitioner, however, applied under the General category and remained unsuccessful. His plea now is that the category was wrongly filled due to the fault of the computer operator. As number of posts are lying vacant, he can be considered against the same.
This court finds no merit in this plea. Once the petitioner has mentioned his category as General category and was duly considered against the same, he cannot turn around and say that he should be considered in the Ex-servicemen/Dependent of Ex-servicemen category. Besides the selection process is now over and vacancies against reserved category may have been carried forward.
