The petitioner was found in possession of 15 bottles or Rexcof. The recovery falls under commercial quantity. Counsel for the petitioner submits that recovery is marginally higher than the commercial quantity and that the petitioner has been falsely implicated in the case. He further submits that there are statutory violations during the course of alleged recovery.
I have heard counsel for the petitioner. In view of bar u/s 37 NDPS Act, I do not deem it appropriate to grant bail to the petitioner. However, taking into consideration the nature of the allegations and the period of detention suffered by the petitioner, the petition is disposed of with a direction that in case the trial is not concluded within six months after the next date of hearing fixed before the trial court, the trial court shall release the petitioner on bail subject to his furnishing bail bonds/ surety bonds to it satisfaction.
