NARESH KUMAR SANGHI, J (Oral) Prayer in this petition, filed under Section 439, Cr.P.C., is for grant of bail to the petitioner, Bikramjit Singh, son of Amarjit Singh, resident of Rani Bagh, Police Station, Kotwali, Nabha, who has been booked for having committed the offences punishable under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985, and Section 420, IPC, in a

case arising out of FIR No. 156, dated 2.9.2013, registered at Police Station, Kotwali, Nabha, District Patiala. After arguing for some time, learned senior counsel for the petitioner prays for withdrawal of the present petition at this stage.

In compliance of the order dated 9.10.2015, interim (zimni) orders passed by learned Trial Court have been received. Perusal of the same would reveal that after framing of charges, the case before learned Trial Court has been adjourned for more than twenty dates and only one prosecution witness has been examined so far. The way in which the trial is being conducted cannot be appreciated. The accused is behind the bars from 2.9.2013. The recovery effected in the present case is huge.

In view of totality of the facts and circumstances of the case, the petitioner is permitted to withdraw the present petition at this stage.

Learned Trial Court is directed to expedite the trial of the present case and conclude the same preferably within nine months from passing of this order.

The Senior Superintendent of Police, Patiala, is directed to issue mandate to all the official witnesses to appear

on 16.11.2015, the date fixed before learned Trial Court so that their statements are recorded.

A copy of this order, under the signatures of the Court Secretary of this Court, be given dasti to learned counsel for the State for onward transmission to the Senior Superintendent of Police, Patiala, for compliance.

A copy of this order be also sent to the learned Trial Court immediately.
