Present writ petition has been filed under Article 226/227 of the Constitution of India inter alia seeking issuance of a writ in the nature of certiorari for setting aside impugned order dated 29.09.2022, Annexure P-16, passed by respondent No.2.

Mr. Rajeev Sharma (Raju), Advocate has put in appearance on behalf of the petitioner and has filed Vakalatnama with no objection from the previous counsel, which is taken on record. He has been heard. 3.

Impugned order, Annexure P-16, has been passed by respondent No.2, by treating the representation of the petitioner as an Appeal under Section 40 of Haryana Agricultural Produce Markets Act, 1961. Petitioner has a remedy of challenging this order by filing a revision petition under Section 40(3) of the Act, which he has not filed. As the petitioner has failed to avail the alternate remedy under the statute, present petition is not maintainable, and is dismissed as such.
