The instant petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case FIR No.70 dated 22.08.2017 registered under Sections 406, 498-A IPC at Police Station Women Cell, Police Commissionerate, Ludhiana. 2.

Counsel for the petitioner would contend that the petitioner had been declared as Proclaimed Offender vide order dated 23.01.2020 in proceedings that had been initiated under Section 319 Cr.P.C. It is submitted that the petitioner sought permission to join the proceedings before the trial Court which was allowed by the High Court by order dated 18.03.2021. It is further submitted that pursuant to the said order the petitioner has joined the proceedings on 07.04.2021 and the PO order stands cancelled on 22.04.2021.

Learned counsel appearing on behalf of the respondent-State on instructions from ASI Vipan Kumar submits that petitioner has joined proceedings.

In view of the fact that the petitioner has joined proceedings, the instant petition is allowed and the order dated 18.03.2021 granting interim bail to the petitioner is made absolute, subject to the conditions laid down in Section 438 (2) Cr.P.C.
