This is a second petition filed by the petitioner seeking the concession of anticipatory bail in FIR No.70 dated 25.08.2023 under Sections 420, 467, 468 and 471 of the IPC registered at Police Station Ghanie Ke Bangar, Tehsil Batala, District Gurdaspur. 2.

The previous petition seeking similar relief was dismissed as withdrawn in the following terms:

"After arguing for some time, when this Court was not inclined to extend the extraordinary concession of anticipatory bail to the petitioner, learned counsel for the petitioner has made a prayer for withdrawal of the instant petition.

Dismissed as withdrawn."

At the outset, a pointed query has been put to the learned counsel as to what is the material change in circumstances, which would warrant entertaining the instant petition, he has miserably failed to bring to the notice of this Court any material change in circumstances except for that the petitioner's wife has been extended the concession of bail. I have heard learned counsel for the petitioner and perused the relevant material on record.

In the facts and circumstances as enumerated hereinabove, this Court is not inclined to extend the extraordinary concession of anticipatory bail to the petitioner.

Accordingly, the instant petition stands dismissed. 7.

However, it is made clear that anything observed hereinabove shall not be construed to be an expression of opinion on the merits of the case.
