Pursuant to the interim order dated 21.1.2016, the petitioner has already joined the investigation, as per the instructions imparted by ASI Satpal Singh to the learned State counsel. Since it is a case where no wrongful loss has been caused to the State property; the petitioner having joined the investigation, the petition can be allowed. The petition is allowed. Interim order dated 21.1.2016 is hereby made absolute subject to all the conditions u/s 438(2) Cr.P.C. with an additional condition that the petitioner will not commit the similar offence, of which he is accused of, during pendency of the trial.
