(ORAL) The petitioner herein has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No. 164 dated 04.05.2015, under Sections 376/376(D)/328/506/120-B IPC and Section 4 of Children from Sexual Offences Act, 2012, registered at Police Station Basti Jodhewal, District Ludhiana.
It is contended by learned counsel for the petitioner that the petitioner has falsely been implicated in this case and he is in custody since 04.05.2015. He is no more required by the police for investigation. The trial is likely to take some time to conclude. No useful purpose would be served by keeping the petitioner behind bars till the conclusion of the trial. He prays that the petitioner be admitted to regular bail. Mr. Abhaypal Singh Gill, learned Asstt. A.G., Punjab, has contested the bail application while filing the custody certificate of the petitioner. Without going into the merits of the case and keeping in view the fact that the statements of the prosecutrix and her mother, complainant, have been recorded and the trial is likely to take some time to conclude, the present petition is accepted and the petitioner is ordered to be released on regular bail on his furnishing bail bonds and surety bonds to the satisfaction of trial Court/Duty Magistrate, concerned.
