(ORAL) Petition herein inter alia is for setting aside impugned order dated 03.01.2023 (Annexure P-9) passed by learned Additional Civil Judge (Senior Division), Yamuna Nagar at Jagadhri, whereby in a suit for permanent injunction instituted by plaintiff/petitioners herein, application filed by respondent/ defendant/counter claimant under Section 151 of Code of Civil Procedure, 1908 (for short 'CPC') for providing police help for implementation of order dated 15.03.2021 (Annexure P-6), was allowed.

It transpires that against order dated 15.03.2021 (Annexure P-6)passed by learned trial Court on an application under Order XXXIX Rules 1 and 2 CPC, a Civil Miscellaneous Appeal No.19-2021 was preferred before learned First Appellate Court which stands dismissed vide order dated 13.03.2023. Resultantly, revision petition before this Court which was filed at the relevant time impugning learned trial Court's order dated 03.01.2023 (Annexure P-9) stating that appeal is though pending but said application filed therein has not being considered, is rendered infructuous. Learned counsel for petitioners states that in any case, steps MAHAVIR SINGH 2023.05.26 15:45 I attest to the accuracy and authenticity of this order/ judgment -1-
2023:PHHC:071704 CR-1369-2023 (O&M) have been taken to challenge aforesaid order dated 13.03.2023 passed by learned First Appellate Court.

Be that as it may, instant revision petition is rendered infructuous and is disposed of accordingly.
