Mr. Varun Gupta, Advocate for the complainant. R.P. NAGRATH, J. (ORAL) This petition under Section 439 Cr.P.C. has been filed by the petitioner for grant of regular bail in FIR No. 211 dated 05.06.2014 registered under Sections 420/467/468/120-B IPC at Police Station Model Town, Rewari.

Allegedly, the petitioner executed an agreement to sell in favour of the complainant on 16.08.2013 for a consideration of ` 25 lacs out of which he received an amount of ` 20 lacs as part of the sale consideration. As per version of the complainant, the entire amount of ` 20 lacs was paid in cash.

CRM-M-14336-2015 -2and the same has been sent for comparison and report of Forensic Science Laboratory, is still awaited. The petitioner is also stated to have transferred the property in question, subsequently, in favour of his family members.

Petitioner is in custody since 31.10.2014 and the challan was presented in January, 2015 and charges have also been framed by the trial Court on 16.02.2015.

The case is triable by a Magistrate and it will take a long time in its conclusion. Without expressing any opinion on the merits of case, the instant petition is allowed.
