Challenge in the present appeal is to the concurrent findings of fact recorded in the suit filed for declaration and permanent injunction by the Courts below by the plaintiff-appellants.

As per office report, the sole appellant stands served, however, there is no representation on its behalf. Mr. S.S. Dinarpur, Advocate who had filed the appeal was also informed about the date fixed, but on being contacted by the Court staff, he pleaded no instructions and that the brief was taken away by the party.

Dismissed for non-prosecution.

Registry is directed to send a copy of this order to the appellant at the last known address, as also to the concerned SHO of the area to intimate the same. 5.

A period of three months is granted for seeking recalling of this order.
