IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH CRM-M-9683-2025 Date of Decision: 19.02.2025 Kuldeep @ Kuldeep Kumar ....Petitioner

Versus

State of Haryana and others ....Respondent

CORAM:

HON'BLE MR. JUSTICE ANOOP CHITKARA

Present:

Mr. Prashant Singh Chauhan, Advocate for the petitioner.

Ms. Trishanjali Sharma, DAG, Haryana.

Mr. Kartik, Advocate for the complainant.

***** ANOOP CHITKARA, J.

FIR No.

Dated Police Station Sections 26.08.2016 Kosli, District 406 & 420 IPC (Subsequently during investigation Rewari Sections 467, 468, 471, 506 & 120-B IPC were added) The petitioner, apprehending arrest in the FIR captioned above, has come up before this Court by filing the present petition under Section 482 BNSS 2023. 2.

Petitioner's counsel seeks anticipatory bail and counsel appearing for the complainant has no objection if this Court grants bail to the petitioner. However, Counsel for the State opposes the bail on the grounds that present petition is not maintainable for the reason that petitioner was declared as proclaimed person. 3.

Given above, present petition is dismissed with liberty to file a fresh after stay/quashing of proclamation order. It is clarified that filing and closure of this petition shall not come in petitioner's way, if he files a fresh bail petition. Pending applications, if any, stand disposed of.
