(ORAL) In the present writ petition, the grievance of the petitioner is that though she has already retired on attaining the age of superannuation on 31.12.2017, but the pensionary benefits for which he is entitled for have not been released to him so far and that too without any valid justification.
Learned counsel for the petitioner states that there is no impediment in the release of the pensionary benefits as there are no proceedings pending against the petitioner either departmental or before any Competent Court of Law, which would entitle the respondents to withhold the pensionary benefits. The prayer of the petitioner is for issuance of a direction to the respondents to release his retiral benefits forthwith alongwith interest on the delay on the release. CWP-5430-2020 -2Learned counsel for the petitioner states that for the relief which has been claimed in the present writ petition, petitioner has submitted a representation dated 11.11.2019 (Annexure P-2) to respondents No.3 and 4, which is still pending consideration and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to respondents No.3 and 4 to decide the said representation. In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, respondents No.3 and 4 are directed to decide the representation dated 11.11.2019 (Annexure P-2) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. Present writ petition stands disposed of.
