(ORAL) Prayer in the present petition filed under Section 482 Cr.P.C. is for issuance of directions to respondents No. 2 and 3 to transfer the investigation of case FIR No. 151 dated 13.08.2019 (Annexure P-1) registered under Section 306 IPC at Police Station Sadar, Patiala, to Central Bureau of Investigation or Special Investigation Team or to any other independent agency.

At the outset, on instructions from ASI Amarpreet Singh, learned counsel for the State submits that the instant petition has been rendered infructuous, as after completion of investigation, challan has already been presented before the trial Court; charges have also been framed by the trial Court and out of total 15 prosecution witnesses, 03 have already been examined. He further submits that next date before the trial Court is 30.09.2023.

CRM-M-8889-2020 -2- 2023:PHHC:106593 Perusal of the order sheets shows that the petitioner had gone un-represented for the last two dates i.e. 08.09.2022 and 24.07.2023.

On the last date of hearing i.e. 24.07.2023, Registry was directed to inform learned counsel for the petitioner about the date fixed. As per office report, learned counsel for the petitioner has been informed about the date fixed through e-mail. However, still there is no representation on behalf of the petitioner for the third time. In view of the above, the instant petition is disposed of as having been rendered infructuous.
