HARPREET SINGH BRAR J. (Oral) Prayer in this 5th petition filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is for grant of regular bail to the petitioner in FIR No.195 dated 10.07.2020 registered under Sections 148, 149, 302, 323, 427, 452 IPC at Police Station Israna, District Panipat. The earlier one was dismissed as withdrawn on 19.09.2024. Custody Certificate dated 22.02.2025, has been filed in the Court today, which is taken on record.

After arguing the case for some time, learned counsel for the petitioner wishes to withdraw the present petition, however, he confines his prayer to the extent that some time bound direction be issued to jurisdictional police authorities as well as the learned trial Court to conclude the trial.

Dismissed as withdrawn.

CRM-M-9574-2025 However, considering the fact that the FIR (supra) was registered on 10.07.2020; the petitioner is behind the bars from the last 04 years and 07 months and 05 days and only 07 PWs have been examined till date, the Superintendent of Police, Panipat, is directed to ensure that all the prosecution witnesses shall appear before the learned trial Court on the next date of hearing, for recording their depositions. The learned trial Court is also directed to take appropriate steps to procure the presence of the prosecution witnesses and conclude the trial expeditiously preferably within a period of 04 months from today.

A copy of this order be supplied to learned State counsel for information and strict compliance.
