This case along with two other connected cases has been called out several times since morning but there is no representation on behalf of the parties.

Same was the position on 02.12.2022, when it was ordered that the appellants and Mr. Gaurav Chopra, Advocate, be notified of the date fixed. As per office report, Mr. Vivek Arora, Advocate, was served through Whatsapp and telephonically, whereas Mr. Gaurav Chopra, Advocate was informed through email.

On 09.12.2022, the Court was informed that the counsel representing the respondent (Mr. Ravinder Chopra, Advocate) had unfortunately passed away and accordingly, notice was issued to the respondent.

The following common order was passed on 11.07.2024:- "In RSA-75-1993 (O&M), Office report dated 09.07.2024 reads as under:- DIWAKER GULATI 2024.11.26 19:21 I attest to the accuracy and integrity of this document

RSA No.75 of 1993 (O&M) -2Sole respondent Company through Partner Shiv Narain Unserved with the report that company has closed and partner Shiv Narain has died.

In RSA Nos.2469 & 2470 of 2000 (O&M), common Office report dated 08/09.07.2024 reads as under:- Sole respondent Company through Partner Shiv Narain Died.

Since no one is appearing on behalf of the appellant(s), purely, in the interest of justice, posted for 25.11.2024. Photocopy of this order be placed on the connected case(s)." 5.

Today, on resumed hearing, no one appears in the Court to press the present appeal and the legal representatives of the deceased parties have not taken any steps to be impleaded to pursue the instant appeal. 6.

In the light of aforesaid, it is safe for this Court to infer that the parties are not interested to pursue this litigation. 7.

Dismissed for non-prosecution.

However, it is made clear that the legal representatives of the deceased parties would be at liberty to seek revival of the present appeal, if any grievance still remains.
