Ms. Shubhra Singh, Additional Advocate General, Haryana. *** The case has been taken up through Video Conferencing. The grouse of the petitioner is that despite orders having been passed by State Information Commission, Chandigarh those are not being complied by State Public Information Officer, as such for getting necessary compliance done, the petitioner has approached this Court by way of filing the present civil writ petition.

Section 20 of the Right to Information Act, 2005 deals with power of State Information Commission to get its order implemented by way of imposing penalty upon the erring Public Information Officer and by way of recommending disciplinary action. The petitioner is said to have approached the State Information Commission, Haryana in that regard which had passed the order but as stated it has not been complied with by the acting Sarpanch, Gram Panchayat, Sanoli Khurd who is designated as Public Information Officer. CWP No. 6192 of 2021 State Information Commission are not being complied with and petitioner has to knock at the door of this Court for getting the orders passed by State Information Commission complied with.

The present writ petition is disposed of issuing direction to State Information Commission, Haryana, Chandigarh to get its order complied with in letter and spirit by taking action under Section 20 of the Right to Information Act, 2005 or any other manner permissible under the law to ensure compliance of its order at the earliest. A copy of order be sent to State Information Commission, Haryana, Chandigarh for information and necessary compliance.
