Seeking release of the alleged detenue, who is none else but the wife of the petitioner, the petitioner has come up before this Court under Article 226 of the Constitution of India.

Learned State counsel, on instructions from HC Shish Pal, submits that there is no threat perception to the wife of the petitioner and she is residing with private respondents. In fact, the petitioner has come up before this Court for release of his wife. On the contrary, learned counsel appearing for the petitioner submits that after completion of the marriage ceremonies, the parents of the alleged detenue did not send her along with the petitioner.

Given above, the wife of the petitioner is residing with private respondents with her free will and therefore, nothing survives in the present petition and the same is dismissed.

Since there is no adjudication on merits, the petitioner is at liberty to take recourse to other legal remedies as available to him, in accordance with law. It is made clear that the order passed in this petition shall not come in the way of the petitioner in case he takes recourse to other legal remedies.
