Seeking quashing of impugned order dated 31.12.2025 passed by respondent No.2 whereby parole of the petitioner has been rejected under the Punjab Good Prisoners (Temporary) Release Act, the petitioner has come up before this Court by filing the present petition under Article 226 of the Constitution of India. 2.

Counsel for the petitioner submits that vide order dated 31.12.2025 passed by Deputy Commissioner-cum-District Magistrate, Hoshiarpur (Annexure P-2), the parole of the petitioner was rejected based on the report that if the petitioner is released on parole, he may indulge in selling intoxicating substances, which can disturb the peace and order of the area.

Counsel for the petitioner submits that the petitioner undertakes not to indulge in any crime and if he commits any offence which prescribes sentence for more than 03 years, then such factor should be considered while granting subsequent parole. 4.

Perusal of the order reflects that there is no reasoning in the order that how petitioner's release is threat to law and order, as such order dated 31.12.2025 passed by Deputy Commissioner-cum-District Magistrate, Hoshiarpur (Annexure P-2) is set aside. Respondent No.2 is directed to pass a fresh order within a period of 15 days. 5.
