(ORAL) This is the second petition under Section 439 Cr.P.C. for regular bail in FIR No. 551 dated 27.12.2019 under Sections 201, 302, 120B, 34 IPC registered at Police Station Pundri, District Kaithal. The earlier petition filed by the petitioner was dismissed on merits vide order dated 22.12.2020.

Learned counsel for the petitioner submits that in the present case, copy of challan was supplied to him at the time of dismissal of the earlier bail petition, and hence, he was unable to present the petitioner's case in a proper manner.

On the other hand, learned State counsel, while making a specific reference to the earlier order dated 22.12.2020, whereby the petitioner's bail petition was dismissed, submits that there being no change of circumstance and no new facts pleaded in the present petition, the same is GURPREET SINGH 2021.04.01 10:44 I attest to the accuracy and integrity of this document Chadigarh liable to be dismissed.

CRM-M No. 13160 of 2021 -2I have heard the learned counsel for the parties. While dismissing the earlier bail petition, this Court took into consideration the pleas taken by the petitioner and passed a detailed order. There is no change of circumstance except filing of challan by the prosecution agency. It could not be shown that the challan presented by the police indicates the innocence of the petitioner, in any manner. Rather, the same is in line with the prosecution version recorded in the FIR. In view of the said fact, this Court finds that no indulgence is required to be given to the petitioner and the prayer for bail is liable to be rejected.
