NARESH KUMAR SANGHI, J (Oral) Prayer in this petition, filed under Section 438, Cr.P.C., is for grant of anticipatory bail to the petitioner, Varun Kohli, son of Preet Mohinder Kohli, resident of House No. 254, Sector 6, Panchkula, who has been booked for having committed the offences punishable under Sections 120-B, 406, 419, 420, 467, 468 and 506, IPC, in a case arising out of FIR No. 410, dated 3.9.2014, registered at Police Station, Sector 5, Panchkula. CRM-M-14456-2015 SI Karam Singh of Economic Offences Wing of District Police, Panchkula, submits that in compliance of the interim directions dated 6.10.2015, the petitioner has joined the investigation, however, he has failed to rationally answer all the questions put to him in the questionnaire prepared by the police. A bare perusal of the questionnaire would reveal that every question put to the petitioner has been answered by him. It is further observed that the signatures of the petitioner have been obtained by the investigating officer, after every answer. Not even a single question remained unanswered by the petitioner. Even if certain questions have not been answered to the satisfaction of the investigating officer, then the petitioner can be directed to further join the investigation.
After hearing learned counsel for the parties and perusing the material available on record, the present petition is allowed. The interim directions issued vide order dated 6.10.2015, are made absolute. The petitioner shall continue to join the investigation as and when required to do so and abide by all the conditions laid down under Section 438(2), Cr.PC.
