******* SURINDER GUPTA, J.(Oral) Present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to petitioners in cross case in FIR No. 86 dated 26.11.2016 registered vide rapat no. 18 dated 27.11.2016 for offences punishable under Sections 326, 324, 323, 148 read with Section 149 of Indian Penal Code (for short 'IPC'), at Police Station Kotbhai, District Shri Muktsar Sahib.
Heard.
Learned State counsel on instructions from ASI Harnek Singh submits that petitioners have since joined the investigation and their custodial interrogation is no more required.
In view of submission of learned State counsel but without expressing any opinion on the merits of the case, this petition is allowed and order dated 18.01.2017 is made absolute till the presentation of challan, subject to the following terms:- (i) that petitioners shall make themselves available for Jitender Kumar 2017.03.30 16:35 I attest to the accuracy and integrity of this document CHANDIGARH interrogation by the police as and when required;
CRM-M-1453 of 2017 -2- (ii) that petitioners shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against them so as to dissuade him from disclosing such facts to the Court or to any police officer;
(iii) that petitioners shall not leave India without the prior permission of the Court.
(iv) that petitioners will seek regular bail on the presentation of challan in Court.
