#  Allegations against the petitioner Lovepreet Singh in this petition filed under Section 439 Cr.P.C. seeking regular bail in case FIR No.84 dated 01.09.2010 registered at Police Station Subhanpur, District Kapurthala under Section 382 IPC, are that while facing trial in this case, the petitioner had absented before the trial Court as a consequence of which his bail was cancelled and bail bonds were forfeited and vide orders dated 03.12.2014 he was declared as Proclaimed Offender and thereafter he is in custody since 06.02.2015.     Contentions of the learned counsel for the petitioner that the petitioner is in custody since more than nine months and that trial is not likely to conclude in near future though are opposed by learned State counsel contending that on account of this gross negligent conduct of the petitioner trial has been put to hold. In the light of these submissions, no doubt conduct of the petitioner throughout the trial has been negligent, however, having regard to the period of incarceration already undergone by the petitioner and the fact that trial will take its own time, impels this Court to allow the prayer made in this petition. Accordingly, the petitioner is ordered to be released on regular bail to the satisfaction of Chief Judicial Magistrate/ Duty Magistrate on heavy bail bonds and two sureties.

The present petition stands disposed off accordingly. However, this order shall not in any manner prejudice the cause of the trial Court to proceed ahead under Section 446 Cr.P.C.
