Reply by way of affidavit of Sarbjit Singh, PPS, Assistant Commissioner of Police, North, Amritsar filed on behalf of State is taken on record.

Petitioner seeks grant of anticipatory bail under Section 438 Cr.P.C. in case bearing FIR No.31 dated 04.02.2021 registered under Sections 379-B (2), 506, 34 IPC at Police Station Sadar, Amritsar City.

CRM-M No. 12187 of 2021 -2Petitioner has also relied upon affidavit executed by father of the complainant before Executive Magistrate, Amritsar stating that Bhupinder Singh son of the deponent and author of FIR had not mentioned the name of the petitioner in any manner and he pleaded no objection in case bail is allowed to the petitioner. Notice of motion was issued on 17.03.2021 and ad interim anticipatory bail was also granted to the petitioner. Learned State counsel on instructions from ASI Karan Singh submits that the petitioner has joined the investigation on 28.03.2021 and even challan has been submitted on 30.04.2021.

With filing of challan, presence of the petitioner is not required for further investigation in the case. In view of above, order dated 17.03.2021 is hereby made absolute.

However, the petitioner shall keep on appearing before the trial Court regularly.

Disposed of.
