RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner - Makhan Singh - in case FIR No.78 dated 18.06.2019 registered under Sections 324, 323, 341, 148, 149 IPC (Sections 325, 326, 506 IPC added lateron) at Police Station Nakodar Sadar, District Jalandhar Rural.

Petitioner is facing trial in the aforementioned FIR along with his four accomplice for causing injuries to complainant Lachhman Singh. Learned counsel inter alia contends that petitioner has falsely been implicated. Grievous injury falling under Section 326 IPC is not attributed to the petitioner, who is in custody since 06.07.2019. Co-accused of the petitioner, namely, Mangal Singh @ Sunny has been granted regular bail by a Co-ordinate Bench vide order dated 05.12.2019 passed in CRMM-41361 of 2019. Treating the case of the petitioner on the same parity as that of his coaccused, he may be also be granted regular bail. On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Treating the case of the petitioner - Makhan Singh - on the same parity as that of his aforesaid co-accused, he (petitioner) is ordered to be released on bail during pendency of trial, if not required in any other case, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
