HARINDER SINGH SIDHU, J Prayer is for grant of anticipatory bail in case FIR No. 13 dated 25.01.2021 under Sections 354, 354-A, 452, 506 and 34 IPC (offence under Section 376(2)(N) IPC was added later on) registered at Police Station Women Yamuna Nagar, District Yamuna Nagar.

FIR was lodged at the instance of complainant Renu Devi, who stated that on 24.01.2021, she was alone at home with her minor child. Her husband had gone out in connection with some work. It is alleged that the petitioner entered room of the complainant at about 11.00 p.m and tried to outrage her modesty. Being frightened, the complainant raised alarm. Then in-laws of the complainant woke up and tried to catch the petitioner but he succeeded to ran away by climbing the wall. On 28.01.2021, statement of the complainant was recorded under Section 164 Cr.P.C wherein she stated that the petitioner had taken her photographs while she was bathing. He blackmailed the complainant by threatening to circulate the photographs on social medial and developed physical relations against her will. Learned counsel for the petitioner submits that the allegations against the petitioner are totally false. CRM-M-12753-2021 (O&M) #2# complainant are known to each other. They have been regularly chatting over the phone. In fact, when the in-laws of the complainant came to know of the affair, they even beat the petitioner and his family members. He has referred to the MLRs (P.4 to P.6) to contend that a complaint was lodged by father of the petitioner against the family members of the complainant, however, no action has been taken thereon.

Since the case is at the threshold and the investigations are underway, it will be practically scuttling the investigation in case the anticipatory bail is granted to the petitioner which will create hurdles in arriving at the truth.

Taking into account the seriousness of allegations and considering the gravity of offence, at this stage, no relief can be given. Dismissed.
