The petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.89 dated 6.8.2016 registered for the offences under Sections 302 and 201 IPC at Police Station Kulgari, District Ferozepur.

Notice of motion to Advocate General, Punjab. Mr. Jasjeet S. Dhaliwal, learned Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner and learned Deputy Advocate General, Punjab appearing for the respondent-State and have gone through the record.

Cr. Misc. No.M-14581 of 2017 [2] From the record, I find that as per FIR all the allegations are against the present petitioner.

Learned counsel for the petitioner argued that there is no cogent evidence against the present petitioner, but the learned State counsel stated that there is motive for causing the murder. There is extra-judicial confession also. There is evidence that the mobile of the petitioner was also recovered from the house of the deceased.

Keeping in view the nature and gravity of the offences and in view of the facts and circumstances of the present case and the fact that the present petitioner is the main accused, I do not find it a fit case where the present petitioner is entitled to the benefit of regular bail. Therefore, finding no merit in this petition, the same is dismissed at this stage.
