The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 3 to correct his date of birth while re-issuing passport.

The petitioner is working with Assam Rifles as a Constable. He was issued passport on 26.10.2005 which was valid upto 25.10.2015. In the passport, the date of birth of the petitioner was recorded as 08.06.1984 and as per petitioner, his correct date of birth is 24.07.1987. 3.

Mr. Gurbir Singh Sidhu, Advocate, submits that all the documents of the petitioner including Birth Certificate and Matriculation Certificate are disclosing his date of birth as 24.07.1987 whereas in the passport, it is recorded as 08.06.1984. Mr. Amit Sharma, Senior panel Counsel, who on advance notice is present in Court, accepts notice and waives service. 6.

Mr. Amit Sharma submits that petitioner may be directed to appear before passport authority on 11.03.2024 alongwith Matriculation Certificate as well as Birth Certificate apart from other documents disclosing his date of birth. On doing so, the passport authority would decide his application, in accordance with law.

Counsel for the petitioner agrees to the aforesaid arrangement. 8.

In the wake of statement of both sides, the petition stands disposed of with a direction to petitioner to appear before passport authority on 11.03.2024 alongwith Matriculation Certificate as well as Birth Certificate, apart from other documents disclosing his date of birth.
