The petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.195 dated 17.9.2016 registered for the offences under Sections 15 and 25 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as `the NDPS Act') at Police Station Mandi Gobindgarh, District Fatehgarh Sahib. Notice of motion to Advocate General, Punjab. Mr. Jasjeet S. Dhaliwal, learned Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.
I have heard learned counsel for the petitioner and learned Deputy Advocate General, Punjab appearing for the respondent-State and Harpal Singh Parmar 2017.05.04 16:40 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-14611 of 2017 [2] have gone through the record.
Learned counsel for the petitioner stated that as per the FIR no specimens have been separated from the case property by the Investigating Officer. I have gone through Police file. As per challan as well as the record of the Police file, the samples have been got separated by the Police authorities from the Court of Illaqa Magistrate. The recovery from the present petitioner is 65 Kgs. poppy husk which falls in commercial quantity and Section 37 of the NDPS Act bars bail in the case of commercial quantity.
Therefore, I do not find merit in this petition and the same is dismissed.
